Pedestrian Struck by Vehicles

Drivers are more distracted than ever before.  Cell phone use while operating motor vehicles has resulted in a significant increase in these cases.  A pedestrian is no match for a several thousand pound vehicle.  We have significant experience handling these cases, especially those which occur on the busy streets of Atlantic City and our shore towns during the high seasons where visitors from out-of-town are unfamiliar with the roadways.

Examples of such a cases include the following.

$937,500 settlement for Atlantic City pedestrian struck in crosswalk.

Our disabled client from Atlantic City was walking home.  As she was in the process of crossing the Atlanitc Avenue, with the right of way, a transport van turned left into her and rolled her over.  The driver failed to see our client in the cross walk as the he was making his left turn that morning.  Our client suffered a shattered hip and required significant surgery.  She was unable to walk for any significant duration due to this injury and her preexisting condition.  The defendant tendered its available policy limit.

$400,000 settlement for an Atlantic City pedestrian struck while crossing the street with the right of way.  Another Atlantic City case.  Our client just finished his shift at McDonald's and was crossing the Albany Avenue with the right away.   He was intendiing to take a bus back to his home in Pleasantville when a United States postal truck turned right at the light, never saw our client, struck him and dragged him before coming to a stop.  Our client sustained a fractured hip and other trauma from the incident.  We made a claim against the United States and were able to resolve the matter in the Federal Court at a settlement conference with the Magistrate.

Other noteworthy pedestrian cases:

Our client was visiting from Canada on a bus trip.  She decided the first thing that she wanted to do when she checked in that morning was to walk to the boardwalk.  As our client was crossing a side street near the Tropicana Casino, a jitney abruptly turned left off of Atlantic Avenue.  The driver testified that he did so in order to avoid a construction delay.  The Jitney side swiped our client and caused her to fall and suffer a hip fracture.  Our client returned to Canada and received treatment there.  We were able to resolve her case for a significant sum.

Our Cape May County client was struck crossing the street as he left a restaurant and was heading for his car.  A driver, turned the corner near the restaurant well beyond the 15 mph speed limit.  Our client was taken by ambulance to the hospital where he passed away two days later.  We resolved the case for the maximum policy limits available to the driver, and obtained a seperate contribution from the drivers personal funds.  We also obtained the maximum benefit available to the client under 4 separate underinsured motorist policy held by our client and his family.

What Should I Do After a Bike Accident in Atlantic City?

Our New Jersey personal injury attorneys understand how traumatizing a bike accident can be. If you find yourself the victim of a bike accident in New Jersey, then some steps to take include:

  • Contact the police. The police will create a report documenting the bike accident. The driver may attempt to blame the cyclist. If this happens, then keep calm and speak with the police. Do not apologize, even if you feel you may be partly to blame for the bicycle crash. Make sure the police include your side of the incident in the police report. Inform them of all injuries sustained, major or minor.
  • Gather witness and driver contact information. Identify anybody who witnessed the bicycle accident and exchange contact information with them. Witness testimony can really help in civil court. If the driver remains at the scene of the bike accident, then take down his or her contact information, driver’s license number and insurance information.
  • Preserve evidence. Take note of road conditions, time of day and precise location of the bike accident. If you are injured, then have a witness write it down for you. Do not fix your bike or wash your clothes from the day of the bike accident. Every piece of evidence can be useful in the litigation process.
  • Seek medical attention. Get medical help for any accident injuries. Your medical record will serve as official proof of injury. Sometimes injuries that seem minor during the initial shock of a bike accident turn out to be more serious than originally expected.
  • Consult an Atlantic City bicycle accident lawyer as soon as possible. Speak with our personal injury attorneys who can help file a bicycle accident claim with the driver’s insurance company, represent your rights in court and work to gain the injury compensation you deserve.

Does New Jersey Have a Bike Helmet Law?

Bike helmet law in NJ requires anyone under the age of 17 to wear a bike helmet. However, it is good practice for all cyclists biking in Atlantic City, Cape May and across the state to wear a properly fitted helmet. Often the most devastating of personal injuries caused by bike accidents are the result of a blow to the head.

Following the New Jersey bicycle laws can also help reduce the risk of being in a bike accident. For example, installing front and back lamps for maximum visibility may reduce the risks of bicycle accidents when nighttime riding. Also, make sure you adhere to all normal traffic laws. These include coming to a complete stop at all stop signs, waiting for traffic lights to turn green before proceeding through intersections and riding in protected bike lanes when available.

Bike accidents can cost families more than just money. Some bike accidents, particularly those involving spinal cord injury, traumatic brain injury or a loved one’s wrongful death, can permanently disrupt your life. You cannot avoid some accidents. However, you can help take responsibility for your own safety by following the New Jersey bicycle rules of the road.
